Abstract
This thesis aims to investigate and compare the evolution and role of judicial power as reflected in the constitutions of France and Turkey. The research begins with a historical overview of judicial authority in France and Turkey, highlighting critical periods and events that have influenced the formation of their judicial systems. This is followed by a comparative analysis of the constitutional provisions related to judicial power in the two countries, focusing on issues such as judicial independence, court structure, and the rights and duties of judges. The research is based on primary sources, including the constitutions of France and Turkey, as well as secondary sources, such as academic articles and books dealing with constitutional justice and comparative law. Through this analysis, the study seeks to understand the institutional differences and similarities affecting the functioning of judicial power in each country and to explore how historical and political developments have shaped their judicial systems. The final part of the thesis presents the conclusions of this comparative analysis, offering recommendations for enhancing judicial independence and judicial efficiency based on lessons learned from the study of the constitutions of France and Turkey.
