Abstract
αγγλικά: In this Master's Thesis, a legal text is translated from Spanish into Greek and commented on: the Judgment of the Inter-American Court of Human Rights of May 14, 2019 in the case of the displacement of the indigenous community Sawhoyamaxa from its territories, a tribe living in the Chaco region of Latin America (the sparsely populated, semi-arid region of the Río de la Plata river basin between Brazil, Argentina, Paraguay and Bolivia), in territory belonging to Paraguay. The Judgment examines the degree of compliance with the measures established at first instance (2006) to redress the injustice to this tribe and return its ancestral lands to its members. The paper begins with a macrostructural analysis, where a comprehensive examination of the text is conducted, presenting the textual type and genre to which it belongs, as well as the decisions on the translation strategies adopted, especially with regard to its cultural aspects. Then, a microstructural analysis is carried out, focusing on the legal language and presenting the individual elements that required special attention, such as terminology, multiple renditions of the same word within the text, attempts to preserve the content even without preserving the form, techniques that helped to overcome translation difficulties and a presentation of the errors in the original text, with reference to the efforts made to correct them. The original and the translated texts are accompanied by relevant audiovisual material that was found and subtitled because of its usefulness in addressing problems and correcting errors in the original.
ισπανικά: En esta Tesis de Maestría se traduce del español al griego y se comenta un texto jurídico: la Sentencia de la Corte Interamericana de Derechos Humanos del 14 de mayo de 2019 en el caso del desplazamiento de la comunidad indígena Sawhoyamaxa de sus territorios, una tribu que vive en la región del Chaco Paraguayo. La sentencia examina el grado de cumplimiento de las medidas ordenadas en primera instancia (2006) para reparar la injusticia con esta tribu y devolver sus tierras ancestrales a sus miembros. La Tesis comienza con un análisis macroestructural, en el que se realiza un examen exhaustivo del texto, presentando el tipo textual y el género al que pertenece, así como las decisiones sobre las estrategias de traducción adoptadas, especialmente en lo que respecta a sus aspectos culturales. A continuación, se lleva a cabo un análisis microestructural, centrado en el lenguaje jurídico, en el que se presentan los elementos individuales que requirieron una atención especial, como la terminología, las múltiples versiones de una misma palabra dentro del texto, los intentos de conservar el contenido incluso sin preservar la forma, las técnicas que ayudaron a superar las dificultades de traducción y una presentación de los errores del texto original, con referencia a los esfuerzos realizados para corregirlos. El texto original y el traducido van acompañados de material audiovisual pertinente que se encontró y subtituló por su utilidad para abordar los problemas y corregir los errores del original.
